By using the Picsort website and services, you agree to these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Eligibility

You must be at least 16 years old to use Picsort. By using our service, you represent that you meet this age requirement and have the legal capacity to enter into this agreement.

3. User Accounts

Account Creation: You may need to create an account to access certain features. You agree to provide accurate information and keep your login credentials secure.
Account Responsibility: You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
Account Termination: We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods. You may delete your account at any time through your account settings.

4. Payment Terms

Pricing: Album processing fees are displayed before you confirm your order. Prices may vary based on the number of pictures in your album.
Payment Processing: Payments are processed securely through Paystack. By making a payment, you agree to Paystack's terms of service.
Refunds: Due to the computational resources required for photo processing, we generally do not offer refunds for completed processing. If you experience a technical issue that prevents delivery of your processed album, contact us within 14 days for assistance.
Free Tier: Albums with 150 or fewer pictures may be processed for free, subject to fair use limitations.

5. Acceptable Use

You agree NOT to use Picsort to:

Upload illegal content, including child sexual abuse material (CSAM)
Upload content you do not have rights to
Infringe on others' intellectual property or privacy rights
Upload pictures of people without their consent where required by law
Attempt to access other users' albums without authorization
Interfere with or disrupt our services
Use automated tools to scrape or collect data
Circumvent any security measures

We reserve the right to remove content and terminate accounts that violate these terms without notice.

6. Content Ownership

Your Content: You retain ownership of all pictures you upload to Picsort. We do not claim ownership of your content.
License to Picsort: By uploading content, you grant Picsort a limited, non-exclusive license to store, process, and display your pictures as necessary to provide our services. This license ends when you delete your content or account.
Processing Output: The organized albums, face clusters, and other outputs we create from your pictures are provided for your personal use.

7. Services

Picsort provides AI-powered photo organization for various events, grouping images by person using facial recognition technology.

8. User Responsibilities

You must supply accurate event pictures and information.
You are responsible for obtaining any necessary consents from individuals in your pictures.
You must ensure you have the right to upload and share the pictures you provide.

9. Retention of Data

We will not store your images or personal information for more than 12 months. After that period, all data will be securely deleted.

10. Intellectual Property

All content, trademarks, and data on this site are owned by Picsort or its licensors. The Picsort name, logo, and service features are protected by intellectual property laws.

11. Disclaimer of Warranties

Our services are provided “as is” without warranty of any kind. We do not guarantee that our facial recognition technology will identify all faces or produce perfect results.

12. Limitation of Liability

To the maximum extent permitted by law, Picsort will not be liable for any indirect or consequential damages arising from the use of our services, including but not limited to loss of data, revenue, or profits.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms shall be resolved in the courts of Lagos, Nigeria.

14. Dispute Resolution

Before pursuing legal action, you agree to first contact us at [email protected] to attempt to resolve any dispute informally. We will respond within 14 business days.

15. Indemnification

You agree to indemnify and hold Picsort harmless from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these Terms.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page and significant changes will be communicated to you via email or through our service.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Picsort regarding your use of our service.
